Terms of Use

The parties agree that C-Loans, Inc., the owner of CommercialLenders.com, is merely selling a list of commercial mortgage lenders ("The Blackburne List") for each state.  C-Loans, Inc. makes no warranty that each, or any, of the commercial lenders on this list will be a suitable match for the Borrower's commercial mortgage loan, or that each, or any, of the commercial lenders on this list will make a commercial loan to the Borrower.

Any buyer of one of these lists ("List Buyer") understands that commercial mortgage lenders are constantly entering and withdrawing from the commercial mortgage market.  One week a bank may be in the market and hungry to make commercial mortgage loans, and the very next week this same bank may flee from the market. A few weeks later the bank may be back in the market, hungry to make commercial loans.  Because these lists are large, it is therefore economically infeasible to keep them always perfectly up-to-date.  The List Buyer understands that he will frequently run across commercial lenders on this list who are currently "out of the market".  In addition loan officers for each lender are constantly coming and going.  The Buyer can expect to find that many loan officers have been replaced by new ones.

The parties specially agree that C-Loans, Inc. is not the List Buyer's mortgage broker, nor his agent. In fact, the List Buyer hereby specifically agrees that C-Loans, Inc. is not his mortgage broker or his agent. C-Loans, Inc. is merely a seller of research data.  The List Buyer understands that in many cases no one from C-Loans, Inc. will ever even look at his commercial loan request.  The Blackburne List is automatically sold by a dumb computer without regard to the fact that the List Buyer may never qualify for a commercial mortgage loan from any commercial lender.  Unqualified Borrowers shall not be entitled to a refund.  

By buying The Blackburne List, the List Buyer agrees to several other things. First of all, the List Buyer agrees to be contacted by phone, fax, and email by the commercial lenders listed on the C-Loans System, a commercial mortgage portal also owned by C-Loans, Inc.  The List Buyer also authorizes C-Loans, Inc. to sell his lead to up to six commercial mortgage brokers, who the List Buyer also hereby authorizes to contact him by phone, fax, and email.

The List Buyer also agrees to be solicited by C-Loans, Inc. and her related / affiliated companies; including, but not limited to, Blackburne & Brown Equity Mortgage Corporation, and Blackburne & Sons Realty Capital Corporation; regularly by phone, fax, and email regarding doing future business together. Mortgage brokers can expect to be solicited regularly by fax and email.

"But George, what if I don't want you faxing me, e-mailing me, or calling me?" Enduring our first advertising fax or email is your cost of using the C-Loans System. You cannot "opt-out" of our first advertising email or advertising fax.

After the first solicitation, you will be provided an 800 number for faxes and an email address whereby you can opt out. But you will probably want to stay on our marketing lists. Most of our customers would agree they are hilarious and sometimes fascinating. We always include tons of jokes and interesting stories in our advertising pieces. This is why we insist that you at least see one of our marketing faxes and one of our e-mail newsletters before opting out. If this freaks you out, simply do not buy a list from CommercialLenders.com.  But you shouldn't be freaked. This is all good, clean business and fun.

We do not offer privacy protection on CommercialLenders.com, and we reserve the right to sell and swap the lists we compile.Once again, this should not freak you out because, as you will see, we do not gather a whole lot of personal information on CommercialLenders.com. I guarantee you that the big on-line marketing firms - and even your own cable TV company - knows fifty times more about you than we will be able to glean from your use of CommecialLenders.com. In any case, hardly no one ever offers to buy or swap for our compiled lists.

Finally, you hereby agree to indemnify, defend and hold C-Loans, Inc.; its officers; its directors; its employees; its agents; its related / affiliated companies and its marketing partners; harmless in connection with any claims or causes of action related to, or arising out of, fax broadcasts or any dispute between the borrower, mortgage broker and/or lender regarding application fees, commitment fees, third party reports, loan commitments and/or up-front fees of any kind.

While C-Loans works hard to screen out advance fee scammers, bad people - despite our hard efforts to police the system - still occasionally slip through. C-Loans, Inc. therefore makes no warranty as to the legitimacy or honesty of any commercial lender listed on The Blackburne List or mortgage broker who buys commercial leads from C-Loans, Inc.  Therefore, please be sure to do your own due diligence, and please be sure to carefully read any term sheets, conditional commitment letters, and/or loan broker fee agreements to determine in advance under what circumstances you are entitled to a refund of any advance fees, good faith deposits and/or third party reports. If something smells fishy - such as a generous loan offer at a rate almost too good to be true - please contact Alicia Gandy at 916-338-3232 or gandy@blackburne.com before sending in a large up-front fee.

Refund Policy:

If you choose to close your commercial mortgage loan with a commercial lender not listed on The Blackburne List, and you successfully close that loan, C-Loans, Inc. will happily and promptly refund 100% of your purchase price of The Blackburne List.
